KHMU Info No. 7(July 31, 2019)

The two nurses fired by the Yeungnam University Medical Center have been staging a sit-in on the roof for a month now.

“ We came up on here to survive. We will make this 13 year long state of being fired done!”

Two fired nurses by the Yeungnam University Medical Center have been on the roof, 70 meter high from the ground, for 30 days now from July 1.

The two nurses have been struggling for reinstatement, demanding for ▲ fact-finding investigations on the planned repression on labor union, punishment on those in charge, and action plans to prevent the repression fired workers’ reinstatement to their original job positions ▲ democratization of the Yeungnam Institute Foundation.

The management at the Medical Center has not implemented the five day workweek system, which was agreed to introduce during the collective bargaining session in 2004. Instead, they have been repressing the labor union in more earnest since 2006, with the consulting contract being signed with a labor service firm notorious for illegal union-busting tactics. The KHMU branch at the Center staged a partial strike for three days in 2006, demanding that it should hire more staff and regularize irregular job positions. In exchange for it, the Center reprimanded 28 former and incumbent leadership members at the branch in February 2007. (10 fired, 8 suspended, salary reduction for ten workers) The Center pressured union members to withdraw from the labor union, leading the union density to decrease to 70 from 950.

In 2010, the Supreme Court ruled that 7 out of 10 fired workers were unfairly dismissed while taking Park Mun-jin and Song Young-sook and another core leadership member as fairly fired workers. They have since struggled for reinstatement for 13 years now from 2007.

The Yeungnam Insitute Foundation, the major shareholder of the Center has been under the power of the former President Park Geun-hye who is now in prison. She left the chair of the board position in 1988 for her responsibility for foundation’s corruption, but she came back in 2006 to secure the controlling power and tried to bust labor union, which is considered an obstacle in operating the foundation.

At that time, the Yeungnam University Medical Center signed the consulting contract with ‘Chang-jo Consulting’ to crack down on the union and the members. The Center stepped into a tightly planned process: violation and non-implementation of agreed items at the collective bargaining à leading the union to go to strike with faithless attitudes to negotiations with the labor union à disciplinary action on and dismissal of union leadership à multi-directional tactics to have union members leave the union. The Chang-jo Consulting which then-conservative government winked at have destroyed 14 democratic unions for 7 years.

During the government audit at the national assembly in 2012, it was disclosed that Chang-jo Consulting played illegal labor-busing tactics under the contract with a number of employers. As a result, the consulting firm’s CEO and others lost their labor consultant’s licenses and trials about their violation against the labor union act is under the progress at the moment.

On July 3, the KHMU staged a resolution rally at the Center, attended by executive members from across the nation, and declared an all-out struggle, making a commitment on the victory without fail with the power of 70,000 union members. At the same time, each regional branch have been visiting the Center for protest picketing and demonstrations every Wednesday. On July 26, they also held a “Testimonial Session of Workers at Yeungnam University Medical Center” at the national assembly. The KHMU has a plan to stage the second round of resolution rally on August 7.   Video: http://youtu.be/hlVV3fOlB0Y
